
The Supreme Court today (05) leave granted to proceed in the Fundamental Rights petition SC/FR/157/23, filed over the shooting of a schoolboy in Thihagoda, Matara an incident that has raised serious concerns regarding the alleged excessive use of force by police officers. The case was taken up before the Supreme Court, where submissions from both the petitioner and the respondents were considered. After reviewing the facts, the Court permitted the matter to proceed, with the next hearing scheduled for 2 June 2026.
The petition cites violations of Articles 11 and 12(1) of the Constitution, relating to freedom from cruel, inhuman, or degrading treatment and the right to equality before the law. The respondents named in the case include an Assistant Superintendent of Police as the first respondent, three Police Sergeants as the second to fourth respondents, and a Police Constable as the fifth respondent. The petitioner, who is the mother of the injured schoolboy, is represented by Attorney-at-Law Lakshan Dias, acting on the instructions of Attorney-at-Law Dayani Panditharatne.
According to the petition, the incident occurred on 28 October 2022, when the schoolboy, who had gone to collect peacock feathers in the Thihagoda area, was allegedly shot by a police officer, causing severe, life-changing injuries. As a result of the gunshot wound, the child remained bedridden for more than two years, unable to move from a single position. While his condition has recently shown slight improvement, he still requires constant assistance for mobility and everyday activities. His education and normal childhood life have been completely disrupted, and his parents continue to endure significant emotional, physical, and financial hardship in providing long-term care.
